Limited Use Motorcycles and Point of Sale Registration
As of January 7, 2025, section 2261 of the NYS Vehicle and Traffic Law is amended to require all limited use motorcycles (aka “mopeds”) sold by a dealer to be registered at the point of sale. Meaning before the vehicle is delivered to a buyer the dealer must issue a permanent registration or temporary certificate of registration (MV-50 TCR). This requires a dealer to process the paperwork at DMV or join the dealer plate issuance program, if eligible. Point-of-sale registration for use exclusively outside of New York is not needed. The buyer must sign a declaration that they understand the conditions when a limited use motorcycle must be registered and the penalties if found in violation. DMV will provide dealers with this form that once signed must be sent by the dealer to DMV. To obtain the form email dmv.sm.platedistribution@dmv.ny.gov with the facility information and formal request.
Note: Registration of limited use vehicles is based upon maximum performance speed:
- Class C: Not more than 20 mph
- Class B: Over 20 mph and not more than 30 mph
- Class A: Over 30 mph and not more than 40 mph
The maximum speed of a certain year, make, and model are declared by manufacturers during a certification process. A limited use motorcycle must be certified by the manufacturer to be registered. Prior to offering this type of vehicle for sale dealers should ensure they are certified. A dealer’s failure to register a moped at the point of sale is subject to administrative action by the Department.
